Title: Sony ordered to pay $90.7 mil.
Description: in patent infringement suit

Since 2002, Immersion Corporation (manufacturers of vibrating gaming technology) have been fighting Sony Computer Entertainment through the courts, arguing that Sony's Dual Shock controllers infringe on patents filed by Immersion before Dual Shock was sold for the first time.

The order, from a California court, forces Sony to pay $90.7Million directly to Immersion for patent infringement. This comes only a few months after a Federal court awarded $82Million in Immersion's favour in September 2004.

However, this time Immersion have won an even greater battle. An injunction is now in force which prevents sales of Dual Shock Controllers (and the Playstation consoles they are bundled with) and around 40 software products including Grand Theft Auto III and Grand Theft Auto: Vice City in the United States.

The injunction is withheld while Sony appeals against it. Sony can continue to sell these products while a court is considering their appeal.

This is the second blow of recent weeks to Sony. Just last week, they launched their Playstation Portable platform and found a much lower level of public interest than they had expected. Store managers have reported having up to 90% of their allocated units still on shelves, which clearly hampers the company's hopes of selling its first million consoles as quickly as possible.

Taken from Gtagaming.com Theres a few more links about this there too.

Its not the 90 mil that will hurt sony. Its the loss of the Dual shock controller. Do you know what this means? All Ps2 units will have to be pulled, so a new controller can be made. This isn't good. I know a lot of the people here don't mind sony geting hurt, but for those of us that enjoy Ps2 AND Xbox(yes, there are many of us) this is troubling news. This also means that any game using the Dual Shock function goes down. Now, I care NOTHING of GTA, but there will be other games cut down because of this. I only hope Sony can at least keep the games out. Maybe they can settle the cse or something.

they can make a different kind

Victorthebattousai - March 29, 2005 03:42 AM (GMT)
Yes, they can, but think of how much it will cost, to bring in all the old units and games, and the remake all of it.

Can't they just rip the vibration function out of the fresh-made controllers?

Honestly, I hate how people can act so selfish. They win one battle, then they get happy. I can understand the winning the money from Sony, but to try to get Sony to alter all of the controllers hurts the community more than it hurts Sony.

Just like that case someone filed against Vice City over a text line(probably for a Rampage mode) that said "Kill all Cubans!" or something like that. They filed a case to get them to change the line. Since they one that, they tried to get VC off of all shelves permanently. I don't think they realized that if they won that, they'd probably be stumped in the middle of the street.

Or that golddigger hoe-chick from The Guy Game that sued Take-Two for putting her in the game topless when she was still under 18(why were you even in front of the camera under 18?! She had to know she'd be put in the game...). Then she tried to sue Sony and Microsoft for letting the game be pushed on their consoles.

What a bunch of |_4|\/|3|2z.

Well, you figure, its going to cost Sony lots, no matter how they do it. Question is, how are they going to re-release the GAMES? You can't just rip the Dual Shock feature from video games. Meaning, they may not be capable of re-releasing them at all. Which, all in all, means we lose games.

PS3 is only a year away, and most people already have controlers for their PS2s. This will hurt Sony's US sales, but it won't stop any hardcore gamers from getting a dual shock controller. This law is only effective in the United States so you can easily import a controller from Japan. Japanese PS2 controllers and memory cards work on the US version of the PS2. Only the games have regional lockout.
