Title: Exchange Visa

Kirsten - August 27, 2007 11:31 AM (GMT)
Hi there, I am very new to this site. I am a Canadian ( I think maybe the only one here..haha  ) doing a job exchange in Adelaide. Very excited about this. I have a bit of a weird situation..I am good about the Exchange Visa..however, my husband is Mexican ( although has permanent residency in Canada)..would he apply for the Holiday visa ( so he can work), while we are still in Canada, or would he still get the automatic spousal visa with my exchange visa...then apply to work, once we get there????? I guess I should probably just talk to AU immigration, but if they are anything like Canadian immigration..then.... :headbang:
Thanks for any info...
Cheers.

hi kirsten, welcome to the forum :welcomesign:

you could try emailing DIAC, but if they dont reply its cos the info is on the website somewhere.
if you go to the site (immi.gov.au) and do a search for your particular visa then there is usually an info booklet you can download that explains everything.
the whole visa process is changing somewhat come 1st sept so what is current now may not be after the 1st.

Hi Kirsten.

Not heard of this visa before but I think it's the Subclass 411.
Details here.....
http://www.immi.gov.au/visitors/special-ac...y/411/index.htm

Spouse, family members and dependants can be included on the application form for the visa.

Under section 5 "Applying for this visa" bottom of the page "More information" it refers you to Form 986i.
Page 2 "Accompanying family members" last sentence states.....
"In most cases, dependants are allowed to work in Australia".

I have only scanned it all quickly so read it thoroughly. However to me that begs the question as to whether a spouse is covered by that statement. ie is a spouse considered a dependant so able to work ?

Secondly what exactly does "in most cases" mean. That gives you no criteria to base your life on does it ?

It looks like you will have to clarify that with DIAC.
I would suggest you do that in writing.
Something on the lines of "I'm applying for the 411 visa, my husband is included on the visa, will he be able to work and are there any limitations on the work he does ?"
Obviously fatten up that with your personal details.

I initially came over on a 457 temp visa. I brought spouse and children with me. All the restrictions and limitations applied to me as the visa holder but the others were free to do what they wished. Maybe that will be similar for the 411 visa.

Anyway good luck and let us know what you find out. :)
